These Terms & Conditions govern the use of services provided by Theme Color to clients (“you”). By engaging with our services, you agree to comply with and be bound by the following terms.
1. Services Offered
Theme Color provides high-quality web design and development services, including Webflow and Framer development, UI/UX design, and branding solutions tailored for startups and modern businesses.
A standard project workflow includes:
- Initial consultation and requirement discussion
- Project proposal and agreement on scope, timeline, and pricing
- Payment confirmation (50% upfront & 50% upon completion or milestone-based)
- Design, development, revisions, and final delivery
2. Project Scope & Revisions
All services are delivered based on the agreed project scope. Any additional features or changes outside the original agreement may require extra time and cost.
Reasonable revisions are included; however, excessive or major changes beyond the agreed scope may be billed separately.
3. Payments & Pricing
A deposit is required before the project begins. Final files or website transfer will only be delivered after full payment is completed.
Late payments may result in project delays, temporary suspension, or additional fees. Theme Color reserves the right to pause work until payments are up to date.
4. Intellectual Property & Portfolio Use
Upon full payment, the final approved deliverables become the property of the client.
Theme Color retains the right to display completed work in portfolios, case studies, and marketing platforms unless confidentiality is requested in writing before project completion.
5. Client Responsibilities
Clients agree to:
- Provide accurate content, assets, and clear instructions
- Give timely feedback and approvals to avoid delays
- Ensure all provided materials have proper rights or licenses
- Not resell or misuse the work without permission
- Not use the project for illegal or unethical purposes
6. Third-Party Tools & Integrations
Projects may involve third-party tools, plugins, hosting services, or platforms. Theme Color is not responsible for changes, pricing updates, outages, or limitations from these services.
7. Project Timeline & Delays
Project timelines are estimates and may vary depending on project complexity and client responsiveness. Delays from the client side may extend delivery timelines.
8. Termination
A project may be terminated if:
- Required input or communication is not provided
- Payment terms are not followed
- There is unprofessional or abusive behavior
- In such cases, no refund will be issued, and completed work may be retained.
9. Limitation of Liability
Theme Color is not liable for:
- Any loss of revenue, profit, or data
- Website issues caused by third-party tools or services
- Delays due to client inaction or external providers
10. Data & Content Responsibility
Clients are responsible for maintaining backups of their content and data. Theme Color is not liable for any data loss during or after project completion.
11. Modifications to Terms
These Terms & Conditions may be updated at any time. Changes will be reflected with a revised effective date. Continued use of services indicates acceptance of the updated terms.
